Equal Credit Opportunity Act (ECOA) Citizens of the United States are protected under the terms of the Equal Credit Opportunity Act so that each person will be treated equally in assessments of creditworthiness for the purposes of taking on debt either through a loan or by applying for a credit or charge card. The awarding of credit may not be restricted according to gender, age, national or racial origins, religious affiliation, marital status, or the receipt of federal assistance in any form. Applicants may be asked to disclose any of these factors voluntarily (with the exception of religious preference) but none of the information may be used against them in the credit determination process. Additionally, no questions may be asked regarding the reception of alimony or child support but the lender may inquire if such payments are being made. Lenders are allowed to consider an individual's credit history, income record, current expenses, and existing debt in making a determination of creditworthiness. More Credit-Card Terms Explained |
