Fair Credit Reporting Act (FCRA) The provisions of the Fair Credit Reporting Act are enforced by the Federal Trade Commission for the express purpose of monitoring the accuracy with which credit related information is transmitted in the United States and the manner in which the privacy and confidentiality of said information is maintained and protected. The legislation covers all aspects of the collection and distribution of consumer credit information and, when taken in tandem with the Fair Debt Collection Practices Act, forms the foundation of the system of consumer credit rights in the nation. The consumer reporting agencies that collect and disseminate consumer credit information as the basis of evaluations of creditworthiness are required, under the provisions of this law, to disclose said information upon request by the consumer. Furthermore, the reporting agencies are prohibited from maintaining negative information for excessive periods of time - generally a limit of seven years but in the case of bankruptcies filings the limit is ten.
